COVID-19 Rent Relief issues for Landlords and Tenants – a WA perspective

COVID-19 Rent Relief issues for Landlords and Tenants – a WA perspective

The Federal Government’s Mandatory Code of Conduct for Commercial Tenancies sets the tone, with specific requirements and support rolled out by each State and Territory, with the long awaited Code for Western Australia released on 29 May 2020.

The Code is intended to be a “roadmap” for how landlords and tenants can work through their leasing relationships during the pandemic and provide clarity as to the way forward. However, as with most legislation or regulations the devil is in the detail.

Watch our panel moderated by Grant Thornton Partner Craig Simon, as they explore the core principles underpinning the Code and the practical issues arising from these here in Western Australia. Featuring panellists:

  • Gehann Perera, Partner, MinterEllison
  • Sandra Brewer, WA Executive Director, Property Council of Australia

During the session, we covered:

  • operation of the Code, including eligibility
  • what tenants need to consider when seeking relief
  • what role do landlords have in the relief process
  • where the uncertainties still lie
  • options available when parties cannot agree.
