Rent Relief issues for Landlords and Tenants during COVID-19

Rent Relief issues for Landlords and Tenants during COVID-19

The Federal Government’s mandatory Commercial Tenancies Code is now being rolled out by the states and territories.

While the devil is usually in the detail of legislation or regulations – this will be on a state by state basis. There are the national guiding principles for landlords and tenants to operate within when negotiating rent relief, however landlords and tenants operating in multiple states will need to ensure compliance for each tenancy and that they are accessing any concessions on offer from the States.

Protections have also been put in place for residential tenancies and landlords will need to understand the impact of these.

Watch our expert panel moderated by Sian Sinclair, National Head of Real Estate & Construction, Grant Thornton, as they explore the core principles underpinning the Code and the practical issues arising from these. Featuring panellists:

  • Ken Morrison, Chief Executive, Property Council of Australia
  • Dale McDermid, Head of Retail Management, Colliers International
  • Phil Campbell-Wilson, Partner, Financial Advisory, Grant Thornton
  • Lynne Kozak, Senior Associate, Minter Ellison.

During the session, we covered:

  • operation of the national code
  • tax and accounting considerations for landlords providing relief
  • what tenants need to consider when seeking relief
  • does the buck stop with the landlords?
  • where the uncertainties still lie
  • options available when parties cannot agree
  • obligations of residential landlords
